UAE midday break: Violators face up to Dh50,000 fine, file suspension, legal action
The UAE Ministry of Human Resources and Emiratisation (MoHRE) has warned employers that strict action will be taken against companies violating the country's midday break regulations, with fines of up to Dh50,000, suspension of company files, and possible legal action in serious cases.
The announcement comes as the UAE continues implementing its Occupational Heat Stress Prevention Policy, which prohibits outdoor work under direct sunlight between 12:30pm and 3:00pm from June 15 to September 15 to protect workers during the peak summer heat.
Penalties for Violating the Midday Break Rule
MoHRE said employers who fail to comply with the midday break policy will face significant administrative and legal consequences.
Penalties include:

Dh5,000 fine per worker found working during restricted hours.

Maximum administrative fine of Dh50,000 for multiple violations.

Suspension of the company's labour file.

Downgrading of the company's classification under MoHRE's tier system.

Referral to the Public Prosecution if violations result in worker injuries or failure to meet legal obligations.
Who Is Exempt from the Midday Break?
The ministry clarified that exemptions apply only to work that cannot be interrupted due to technical, operational, or public safety requirements.
Exempted activities include:

Emergency repairs to water, electricity, and telecommunications services.

Work required to maintain traffic flow and essential public services.

Activities that require official permits because of their impact on public life or infrastructure.

MoHRE noted that while certain activities are automatically covered under the exemption policy, businesses must still obtain any required permits from the relevant authorities where applicable.
Employers Must Ensure Worker Safety
Even companies carrying out exempted work are required to provide a safe working environment and comply with occupational health and safety regulations.
Employers must provide:

Shaded rest areas for workers.

Cold drinking water.

Hydration supplements such as electrolytes.

Cooling equipment, including fans and mechanical cooling devices.

Fully equipped first-aid kits at work sites.
Delivery Riders Also Protected
MoHRE confirmed that delivery riders are covered under the midday break policy. Riders cannot be forced to work during the restricted hours if they choose not to, while deliveries on foot are prohibited between 12:30pm and 3:00pm throughout the implementation period.

The ministry said its inspection teams use advanced digital monitoring tools to identify violations and distinguish between exempted work and routine outdoor activities that must stop during midday break hours.
